General Terms
Payments may be made either in cash, by check, Master Card, VISA, Discover or American Express. For "print regardless" orders we may require payment with the order. We offer our own charge accounts for established customers. Billing will be done on the last working day of the month.Payments are due on the tenth day after billing date. Accounts unpaid by the next billing date will be considered overdue and may be suspended. A finance charge of 1½% per month (18% annual rate) of the outstanding balance will be added to overdue accounts. Prices and services offered are subject to change without notice.
Remakes
If the quality of our product is deemed unsatisfactory by the customer we will try to deliver a satisfactory product or -at our option- refund the purchase price. Remakes will be made under the condition that: (1) the unsatisfactory product is returned to us. (2) that the original instructions are returned and (3) that clear, written instructions are provided describing what corrections are to be made. We reserve the right to refuse remakes or refunds if the material delivered meets our normal standards of quality for the level of product ordered.
Print Regardless
Originals which are either grossly under- or overexposed, show severe color distortions or have other flaws which, in our opinion, will make it impossible to deliver an acceptable product will be returned. At the request of the customer we will accept such orders on a "print regardless" basis. We will deliver the best product possible under the circumstances with the understanding that no remakes will be performed and no refunds be made for unsatisfactory quality. We may require payment at the time of the acceptance of a “print regardless” order.
Service Times
Service times listed are working days in the lab. The times listed are guidelines only. They do not include holidays and weekends nor any time required for shipping or delivery. Larger print sizes and larger orders may require additional time. If faster than normal service is required, Rush Service charges may be applied. Overtime charges of $50.00 / hour apply if the job cannot be completed during normal business hours. If you have a deadline to meet, please specify this in your order. We will do our utmost to complete your order in the time specified.
Copyrighted Material
Kalamazoo Color Lab will stictly observe all copyright laws. It is unlawful to duplicate copyrighted materials without the written permission of the copyright holder. The submission of materials for reproduction or duplication by us constitutes an agreement to hold Kalamazoo Color Lab harmless for any penalties and damages, including reasonable attorney fees which may be assessed against us.
Limitation of Liability
The acceptance of any film, print or other material by us for processing or for any other purpose constitutes an agreement by you that if such film, print or other material is damaged or lost by us it will be replaced with an equivalent amount of unexposed film. Except for such replacement, the handling of such film, print or other material by us is without warranty or liability even if such damage or loss is caused by negligence or other fault. We assume no liability for loss of orders in transit to and from our lab.
